If JP is correct the seller on ebay is the bad boy, you're just an unknowing customer that thinks he's getting a great deal on a super duper chip from overseas.

The seller is only the bad boy if Intel decides to care, but they never have in the past and see no reason why they ever would. When the topic first came up i read Intel's legal position on the ES CPUs on the Intel site. Legally, possessing an ES is not illegal in even the slightest way.
